existing insulation in the basement has to be removed and replaced

1) Why is arc fault required for the basement but not the rest of the house. Makes no sense
but
2) The house is 6 years old. The insulation was installed by the builder. WHY THE FUCK IS IT NOT OK FOR USE WHEN FINISHING THE BASEMENT? How was this approved in the first place?
