We have numerous accidents involving pedestrians here that aren't the fault of the driver, and aren't prosecuted as such.

Ask any of the DC'ites about the number of people hit on 355 trying to race traffic. Many of those cases simply end up the jaywalking pedestrian got struck by a vehicle operating within the law...pedestrian's fault; no charges filed.
