STIS: Question about a desk chair seat adjustor being broken

So I bought this desk chair at CVS (yeah I know, but I have the exact one at home which works great) and am pretty sure its broken. I attached the bracket to the bottom of the chair and the "gas pipe" to raise and lower the seat etc. Well whenever I sit on the chair it immediately sinks down and the pipe doesn't maintain the height. I can raise it back up, but with weight it goes right back down. This is just a problem with the tube right, I mean it's put together correctly?

Also, the "gas pipe" or whatever you call it, is now stuck in the base, as well as the bracket that attaches to the bottom of the chair. It barely fits in the box, but this causes the cushions to not fit. They pretty much have to accept the return anyway right? I have the receipt.

I know this is a stupid question, and without seeing it, it's hard to tell, so thanks!
