My issue with this is that it's an argument against sentencing unless the state can be perfect.

I don't see how it's any better to jail an innocent person who then dies from a shiv or disease in prison a year into his five year term, or to say, "sure he was innocent, but at least he only got a life sentence" rather than execution.
Isn't "one innocent man sent to prison is too many" then for all?
