The problem is you can't make a rule of law on that basis (even assuming we all agree that they should die (which obviously everyone doesn't)). Cases

of equal magnitude are not all clear cut. So we need rules to make sure we treat people fairly and don't kill innocent people. There are lots of cases of the wrong guy on death row. So when you draw up the rules it makes the reality and the concept not work together. And that puts aside all the issues of racism and other prejudices that have historically greatly influenced the imposition of the death penalty.
