If the gun was defective, it could have been a contributing factor.

That's a huge if, and will lead to a lot of testimony, I'm sure. I am not blaming the gun, I don't know most of the facts But on the surface, the case doesn't sound completely frivolous to the point that it shouldn't at least be heard preliminarily, to see if there is a case.
