If the people making the t-shirts were doing it not-for-profit, and to keep up his memory/inspiration then I'd see your argument.

otherwise it's profiting off his work, cheapening it, and I think his kids deserve some say in it.

And I believe The King children wouldn't be interested unless there was a profit involved because profiting off his legacy is pretty much their M.O.
