I conceded that malpractice litigation is a valid tool. I'm just defending the idea that some tort reform is in order. I don't think malpractice litigation should be completely abolished, just that big cash payouts seem to have the effect of driving up costs across the board and causing doctors to order lots of unnecessary procedures out of fear of litigation. Surely there's a better solution.
