That exception is, if he has inside knowledge about Al Queda (which I doubt that he does), then he might qualify for a "special" interrogation. You know, Jack Bauer style.
But his criminal prosecution should proceed according to American laws, not the laws of another country (although I guess the next leading legal precedence would fall to the Netherlands, I think ...).
