I'm not sure that's what he's saying.

our system's so hosed up that any fair and balanced application of that punishment is prety much not accurate so as to deny any perceived validity of the punishment in the first place.

I'm pro-death penalty. I am disgusted by how our current system works in regards to that. That bullshit on B2; the Texas lawyer who slept on his client; the entire Texas board of appeals is a bastardization of the penalty. The racial/gender breakdown of those sentenced vs not....disturbing.
