LOST spoils

I'm not convinced that Smokey is a distinct creature from Jacob's brother. Otherwise, why would the rules against killing each other still be in effect? Unless Smokey is somehow constrained from killing Jacob by a different mechanism, but everything I've seen seems to indicate that the present day struggle is just an extension of the Game they started playing on the beach as kids...
