They're suing to bounce the attorney representing the Siegels. If they succeed, it would be quite a coup. If I remember my copyright law, Toberoff was instrumental in helping Disney rape the family holding the rights to Winnie the Pooh.

DC (well, Warner) has 2 years to get the rights back... not barring any injunctions that extend the deadline. They've hired new lawyers and are pulling out all the stops.
