I think Ben killed his nemisis not to get Penny killed but to keep Smokey from getting needed info from him. He turns on Smokey when the time is right.
Considering how Smokey is offering him the Island and at the end of this episode he says his intent is to destroy it...Ben wouldn;t want that and I think knew all along it was coming.
