To sum up: There is a law that says every manufacturer has to make at least one device that is HA compatible.

Apple gets away with it because they make only one device, and there's a loophole.
Although they are not breaking the law, the word from hearing loss advocacy groups is that Apple has been super jerks about it from day one. Hearing loss advocates had meetings and talks with Apple during the design process, and Apple basically ignored them.
Every other company out there has been good about it. They have not been good about it.
