Legally, yeah, I can see that but in terms of for the individual, it seems problematic.

For that hypothetical prisoner, the fact that the state has done its due dilligence doesn't really help.
I'm not saying it's bad, just that it's the nature of spiritual/moral guidance when dealing with a patchwork of belief systems.
