It isn't about Norton not showing he can make money.

His Hulk movie made just under budget ($135-140M)domestically, and just a bit less than that internationally. It's sold about $60M in dvds.
And it opened fairly strong at $55M. That's just under Kung Fu Panda, which was a hit.
The problem wasn't Norton, it's that the movie wasn't that good. And that the brand was damaged by the Ang Lee predecessor.
Also, the complaint isn't that Marvel said the movie was bad and they wanted to go with someone else. The complaint is that after Marvel had asked him to return, put things in motion for him to return, and started negotiating his return, they made defamatory comments about him to the press after they changed their minds.
They tell him upfront they don't want him back, there is likely no issue. They decide to go with someone else even after asking him to return, there likely isn't much of an issue. They ask him to return, start negotiating with him to return, and then slam him to the press when they change their minds, then there is an issue, as well there should be.
