I remember an old meme that points out how Microsoft's Windows TOS states that it should not be used for mission critical systems.

Specifically, it shouldn't be used to run a nuclear reactor (this is actually stipulated clearly). I don't think there's any liability when you use a product against its terms of service, just like Lego can't be held liable if BP decided to build its monitoring systems out of little toy plastic bricks.
