I don't know if it's illegal, but since raccoons are nocturnal it's probably not cool for it to be walking around in the morning.

When I worked at a Girl Scout camp we had to call in an animal wrangler/conservationist to come get a baby raccoon who was hanging out during the day. (The campers were trying to feed it 'cuz he was cute.) There is a possibility of rabies when they're that disoriented.
