If they wanted to, say, tell employers that misdemeanors and bankruptcies could not exclude a candidate from being hired...

then fine. I agree with that. But the rationale that the reason its problematic is not because it isn't the kind of information that is helpful in determining if the candidate is a trustworthy employee, but because it would eliminate more candidates from one race than another race is butt fucking asinine.
