i feel virtually certain that if someone were to, say, only have a 90 second clip from that movie on their computer, absent any other context that would lend it literary value, that person could be prosecuted without hesitation. so we're talking about a film that incorporated elements of that type of material to make an allegory that (again, trusting other reviews here) isn't even necessarily close to the forefront of the movie, and generally has to be explained by the filmmakers after the movie for any American audience to "get it". i think that is treading on pretty thin ice.
