From what we've seen I've never seen Jane as a slam dunk winner with the jury that is there. What evidence do we have that the plurality would have gone with the sympathy vote? Brenda? Naonka? Marty hates her, but he could vote for her to win just to prove himself correct. Maybe there is more to it because everyone seems to believe it, but maybe that just points to how effective Marty was at guaranteeing that if he couldn't win, then neither could Jane. They scorched Earth each other because they let emotions get in the way.
