sue claiming the medical provider is the one with expert knowledge of the potential complications, which are not apparent to the lay person even when they're told about them, because the procedure doesn't appear to be a big deal. You were unable to give informed consent to be released to a random 3rd party, because you were unable to comprehend the inherebt risks in such a decision. It's pretty condescending, but juries have bought it in past cases, so they protect themselves.
