I'm gonna have to go back and review all the filings again, but I'm guessing it's one of two things: either a spectacularly bad oversight by the lawyers who drew up the papers transferring the rights from Fox to Warner, or the judge has a spectacularly bad misunderstanding of copyright law. Either way, there's a good story brewing here.
