no, that's a penalty...it's contact past 5 yards. And now, that he's broken the rules, you have a reason

all you have here is an injury resulting from the design of the playing field from a legitimate contact in a contact sport.
it sucks, bad shit happens.
This is more, you're driving down the street at legal speed and a child darts in front of you...and you end up killing the kid.
Cops aren't charging you unless you did something wrong. Bad shit happens.
