they always charge murder if someone dies, its up to the DA to follow through

Involuntary manslaughter is still a threat of jail, plus a conviction, lots of legal bills. depending on the town, they maybe annoyed by panhandlers and realize the guy meant only to protect his car (these window washers schmear whatever cleaning product they can shoplift and usually leave a bigger mess to clean than before. I've had lemon pledge squirted on which is a wax type product and took a lot of effort to clean off)
of course the station probably has a video camera showing the whole thing and could make the guy seem like an arrogant bastard violently shoving the guy away from his car, or someone who inadvertantly jostled the guy a little briskly.
